Terms of service

These Terms govern your purchase of goods from the Optimistic Media shop at
shop.optimisticmedia.net, operated by Optimistic Media LLC ("we", "us"). By
placing an order you agree to them. Our Refund policy and Shipping policy form
part of these Terms.

WHO CAN ORDER

You must be at least 18, or the age of majority where you live, to place an
order. By ordering you confirm the payment method is yours and the information
you give us is accurate and complete.

MADE-TO-ORDER PRODUCTS

Most items are produced after you order it, by our print partner, and shipped
directly to you. Two consequences worth stating plainly:

• Handmade and printed goods vary slightly. Colours on your screen will not
match the printed item exactly, and print placement can shift a small amount
between items. This is normal for print-on-demand and is not a defect.
• Because nothing is held in stock, orders cannot be changed or cancelled once
production has begun. See our Refund policy for the full detail.

Please use the size chart on each product page. Items ordered in the wrong size
cannot be returned.

PRICES, TAXES AND PAYMENT

Prices are shown in US dollars and may change at any time before you order.
Sales tax is calculated at checkout where it applies.

For international orders, import duties, customs charges and local taxes are
not included and are the recipient's responsibility. We cannot predict these
charges and cannot refund an order refused or abandoned because of them.

Payment is taken when you place the order. We accept the payment methods shown
at checkout.

ORDER ACCEPTANCE

Your order is an offer to buy. We may decline or cancel any order, before or
after payment, including where an item is unavailable, a price or description
was wrong, payment cannot be verified, or we suspect fraud or resale. If we
cancel an order you have paid for, we refund it in full.

SHIPPING AND DELIVERY

Delivery estimates are shown at checkout and are estimates, not guarantees.
Production time is separate from shipping time. Risk of loss passes to you on
delivery by the carrier. Packages confirmed lost in transit are covered — see
our Refund policy.

You are responsible for giving a complete and correct shipping address. We
cannot redirect a package once it has shipped, and orders lost because of an
address error are not covered.

RETURNS AND REFUNDS

Our Refund policy sets out what we replace or refund, the 30-day window, and
what we cannot accept. It is incorporated into these Terms.

INTELLECTUAL PROPERTY

All designs, artwork, text, logos and images in this shop are owned by
Optimistic Media LLC or used with permission. Buying a product gives you the
product, not the artwork on it. You may not reproduce, resell, redistribute or
use our designs commercially without written permission.

ACCEPTABLE USE

Do not use this shop unlawfully, attempt to interfere with or gain
unauthorised access to it, scrape it by automated means beyond ordinary search
engine indexing, or purchase for resale without our written agreement.

FULFILMENT BY THIRD PARTIES

Our products are manufactured and shipped by third-party print partners. We
remain responsible to you for your order under these Terms and our Refund
policy.

DISCLAIMERS AND LIMITATION OF LIABILITY

Products and this shop are provided "as is" to the fullest extent permitted by
law. Nothing here excludes liability that cannot lawfully be excluded,
including for death or personal injury caused by negligence, fraud, or your
statutory rights as a consumer.

To the maximum extent permitted by law, our total liability for any order is
limited to the amount you paid for that order, and we are not liable for
indirect or consequential loss.

YOUR STATUTORY RIGHTS

Nothing in these Terms limits rights you have under consumer law in your
country or state. Where your local law gives you more than these Terms do,
your local law applies.

GOVERNING LAW

These Terms are governed by the laws of the State of Colorado, USA, without
regard to its conflict-of-laws rules. Disputes will be brought in the state or
federal courts located in Colorado, except where your local consumer law gives
you the right to bring a claim elsewhere.

CHANGES

We may update these Terms. The version published here when you place an order
is the version that applies to that order.
